We are bound by the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and other privacy legislation that details the principles concerning the privacy of individuals, their Personal Data and Personally Identifiable Information.

This Website and its contents (“Website”) is owned and operated by Acacia Limousines Townsville. While we endeavour to take reasonable care in preparing and maintaining the information on this Website, we do not warrant the accuracy, reliability, adequacy or completeness of any part of the Website content. It is your responsibility to enquire with us directly to ensure the currency or accuracy or information you seek to rely on. You acknowledge and accept that the Website content may include technical inaccuracies or typographical errors. the Website content is subject to change at any time without notice and not necessarily be up to date or accurate at the time you view it.

Terms & Conditions

General Terms of Carriage

By confirming a booking with Acacia Limousines Townsville (Acacia) and its associated Operators, Licensees, Lessees and Drivers/Chauffeurs, you, the hirer is agreeing with our Terms & Conditions, including our Booking, Cancellation, Refund and Payment policies.  We reserve the right to change our service charges and any of the following Terms & Conditions without notice. 

 Acacia and its associated Operators, Licensees, Lessees and Drivers/Chauffeurs are not common carriers and may refuse to carry any person(s) without giving reason.  Acacia and each Operator and Licensee is responsible for services provided by it and has no liability for any other services. Passengers travel at their own risk.

 It is the hirer’s responsibility to read the FULL TERMS & CONDITIONS closely as confirming a booking confirms you accept and are bound by the TERMS & CONDITIONS.

 Subject to the terms, Acacia, its Operators, Licensees, Lessees and Drivers/Chauffeurs, have no responsibility for costs or losses including missed flights or travel connections, resulting from diversion, substitution, alterations, cancellations, delays or booking errors. It is the hirer’s responsibility to advise in writing any changes as full costs may be incurred.

 Passengers must comply with all laws and regulations in the state they are travelling and with the instructions of Acacia, its Operators, Licensees, Lessees and Drivers/Chauffeurs and Administration staff. Except as otherwise provided by these terms, and to the extent permitted by law: (a) Operators, Licensees, Lessees and Drivers/Chauffeurs, are not liable for death of or injury to any person, for loss or damage to luggage or goods, for delays, for errors in bookings or times, or for consequential or other loss of any kind, arising directly or indirectly from negligence or omission or some other cause in connection with provision or non-provision of any services and (b) Is not liable for inaccuracy in any information concerning transport services or its prices.

Amendments

Any changes/amendments to your booking after confirmation can only be accepted subject to availability. Acacia, its Operators, Licensees, Lessees and Drivers/Chauffeurs, reserves the right to charge an amendment fee in respect of any change to your booking, in addition to any other applicable charges in relation to the amendment. While efforts will be made to accommodate booking changes, Acacia does not guarantee that changes to bookings will be actioned without sufficient written notice (at least 48 hours’ notice during regular business hours and longer for weekends and/or public holidays).

 

Vehicle bookings & guarantees

Acacia does not guarantee that a particular vehicle will be available for transfers.  Acacia does not guarantee a vehicle will be available on submission of Booking Form/s, or request on the App and website, and recommends that vehicles (especially stretch limousines) are secured six months in advance to avoid disappointment. Whilst Acacia provides accurate information about our fleet and available vehicles for hire at the time of booking, circumstances outside of our control (such as accidents) may necessitate that a replacement vehicle is required.  We will endeavour to provide a like-for-like replacement to ensure that wherever possible, the original intent of the booking is maintained.  Acacia will not be responsible or liable for changes to vehicle types that occur beyond the reasonable control of the company.

 

Consumption in vehicles

Food and beverages, excluding bottled water, are not to be consumed in vehicles.

Credit card transactions & surcharges

Transport services may be made by credit card.   The purchaser agrees to make payment in full when billed.  Special occasion events (Weddings, Formals, Hen’s and Buck’s Nights) require the provision of a valid credit card number, expiry date and CCV at the time of booking.  The purchaser agrees that the credit card will be deducted if there is damage to the vehicle or the booking runs over time. 

Credit card surcharges apply at the discretion of the Customer Service Centre.  Additional charges apply for bookings made by AMEX.

Customer safety

Our chauffeurs/drivers will at all times drive at safe and sensible speeds and in accordance with legal speed limits, traffic and current road conditions.  All drivers reserve the right to deny access to a venue or road, bridge or area they feel may put the passengers and vehicle in an unsafe situation.

 

Damage to vehicles &/or inappropriate behaviour

Passengers travelling in an Acacia vehicle agree to abide by reasonable and lawful conduct.  You, the client, are liable for any charge levied by Acacia, its Operator or Licensees in respect of any damage caused to a vehicle due to your instructions or any directions you give to the driver or chauffeur. The driver or chauffeur reserves the right to evict any clients from the vehicle due to any unsafe, inappropriate or unruly behaviour. No refund will be offered in these circumstances.

Extensions & extra charges

The hirer is responsible for any charges levied by Acacia, its Operators or Licensees, in respect of extra time in the event that changes are made to the original booking either by the booker or passenger. This includes any extra charges levied where you choose to extend the duration of your booking and/or add additional stops to the original booking.  In the event of extra charges or extensions (refer above) the passenger is to immediately pay the extra charge to the chauffeur either prior to or upon completion of transfer. Additional charges can be charged back to your Acacia account or your credit card if this was used to secure the booking originally.

Insurance

Acacia, its Operators and Licensees are insured for passenger travel. This insurance is for public liability and NOT travel insurance. Although every effort will be made to ensure the safe keeping of personal property, we do not accept liability for loss or damage of personal items. Please check that you have sufficient coverage for any personal property that is brought onto our vehicles.

Lost property

Acacia, its Operators and Licensees will not assume liability for any lost or misplaced personal property. In the event the customer leaves personal items in the vehicle, Acacia its Operators and Licensees shall try to deliver any items back to the Customer at their expense or the item/s may be collected from our Customer Service Centre.  Appropriate identification must be provided prior to the release of lost property.

Luggage & baggage information

Our sedan’s maximum luggage limitations are two (2) regular-sized suitcases (check in size for a plane) plus two (2) piece of hand luggage/soft luggage (carry-on for a plane) or one (1) large suitcase plus one (1) set of Golf Clubs and one (1) soft luggage.

 

Customers should consider booking a larger vehicle such as a People Mover with trailer if they have more luggage than a sedan can accommodate. Additional luggage transfer will incur further cost to the client, price on application at the time of booking. No suitcases will be transported inside the passenger area of the vehicle due to transport regulations & safety concerns.

Multiple pick-ups &/or set downs

Additional charges may apply for all extra pickup/set downs required en-route unless already quoted. This will be discussed at the point of booking.

On-time services

Please be assured that Acacia, its Operators and Licensees, will take every reasonable safeguard to achieve an on-time service, however in the unlikely event of our chauffeurs being late due to circumstances howsoever caused, no liability will be accepted by Acacia, its Operators, Licensees, Lessees and Drivers/Chauffeurs.

Pets

Pets are permitted in vehicles, but passengers are requested to communicate their intent to carry a pet at the time of booking.  All pets must be suitably restrained for safety reasons and travel in a crate or on a mat with a seatbelt restraint used.

Under Australian law, registered Assistance Dogs travel in the vehicle beside the handler or in the floor well at the discretion of the customer.

Quotations

Prices are current at the time of quotation and subject to availability at the time of booking. All quoted prices include GST. Acacia, its Operators & Licensees, reserve the right to pass on, without notice, any increases that may occur in any applicable airport charges, road & tolls, entry fees or parking charges in addition to extra charges for driver remuneration.  Quotations are current for a period of 30 days after which time Acacia, its Operators & Licensees reserve the right to review the quotation and re-issue.

Acacia, its Operators, Licensees, Lessees and Drivers/Chauffeurs, reserve the right to charge waiting time where a quote for a split booking is requested.  The application of charges in the case of split bookings is at the discretion of Acacia and/or its representatives.  Acacia reserves the right to on-charge for fees and charges related to applicable charges as above.

Airport delays on location waiting:

in regard to airport pickups, Acacia its Operators and Licensees will monitor all aircraft movements. If passengers are delayed after arriving at the terminal, additional fees may apply.

Seat belts

Under Australian law, it is compulsory that all passengers wear seat belts where fitted at all times when the vehicle is in motion.

Smoking & illicit drugs

Smoking is not permitted by state law in any Acacia vehicle. Charges will apply, at the discretion of the chauffeur or Acacia, if any passenger is found to be smoking in any Acacia, or Acacia service-providers’ vehicle.

The consumption or carriage of illicit drugs is strictly prohibited in Acacia vehicles.  Hire will be immediately terminated, and no refund provided if any passenger consumes or carries illicit drugs in an Acacia vehicle. Involvement of the Queensland Police Service will also occur.

 

Special events (Weddings, School Formals, Graduations, sporting events or concerts)

Either full payment or a deposit is required for Special Occasions such as, but not limited to, Weddings, School Formals, Sporting Events and Concerts.

Weddings, School Formal and Graduations

All bookings MUST be secured by a non-refundable deposit with the balance payable 30 days prior to the event.  If a deposit has been made, full payment of the balance is required 30 days prior to the event.  Surcharges may apply to such events.

All bookings for Weddings, School Formals and Graduations must be accompanied by a completed booking form.  Credit card details are required to secure all bookings. Acacia reserves the right to charge additional waiting time or damage to vehicles to the credit card provided on the booking form.

 

Sporting Events, Concerts & other Special Events

Full payment at the time of booking is required to secure a vehicle for Sporting Events, Concerts & other Special Events.  Surcharges may apply to such events.  Credit card details are required to secure all bookings.

Subcontracting

Acacia, its Operators and Licensees, reserve the right to use the services of other approved hire car/limousine/bus service providers as required. These operators have been pre-qualified by Acacia and deemed to be of a sufficient quality to provide services on Acacia’ behalf. These providers, for the duration of the booking, remain under the supervision of Acacia, its Operators and Licensees, at all times.

 

Cancellation Policy

A hirer making any booking with Acacia confirms that you the hirer agrees to abide in full with our cancellation policy and the fees and guidelines that apply in relation to this.  Refunds will only be provided when the hirer fulfils the below and where the cancellation is EMAILED to our email address (admin@acacialimousine.com.au) AND is accompanied by a PHONE CALL advising Acacia of the cancellation email.  ALL cancellation emails MUST be received during our regular business hours (excluding Saturdays, Sundays, nights [between 5pm and 9am business days] and public holidays). Cancellations made via social media will not be accepted as email confirmations. 

We are very strict with our cancellation policy. All vehicle bookings are taken in good faith and clients who cancel without sufficient notice, have restricted others from booking the vehicle for those dates and/or times. When a vehicle has been booked for blocks of time or consecutive days, this also means we miss the opportunity to re-book the vehicle and/or contact clients on our waiting list.

Cancellation charges whereby the hirer forfeits the full fee for hire will apply when:

  • Cancellations are made with less than 5 working day’s notice (Monday to Friday) prior to the dispatch of the vehicle. Working days do not include public holidays or weekends.

  • Any Stretch Limousine booking is cancelled, at any time regardless of notice, after being confirmed; or

  • Bookings where the passengers fail to arrive or make contact with the chauffeur or the local Acacia Customer Service Centre during Monday – Friday business hours.

  • Stricter cancellation policies may apply to any of the above, however will be advised to you at the time of booking and will supersede the above policies.

Our cancellation policy is strictly adhered to and we request that all people hiring our vehicles are aware of these at the time of booking.

Any cancellation that is made in line with the above and that has been paid in full, may be refunded less a booking fee.  The minimum booking fee charge is $50 for standard transfers.

A Special Cancellation Policy applies for Weddings and Events.  No monies will be refunded for any Wedding, Formal and/or Special Event booking. 

In the event of a government-enforced closure (eg COVID-19) Acacia will provide a credit for Wedding, Formal or Special Event bookings and work with the hirer to identify a mutually suitable time to complete the service.

Acacia recommends that the hirer is aware of these policies at the time of booking. No discussion will be entered into in relation to booking fees or cancellations.

 

Waiting Time

Acacia offers well above industry-standard complimentary waiting time for all bookings.

 

Complimentary waiting time is applied as follows:

  • 10 minutes complimentary waiting time at homes, hotels or other non-airport pickups.

  • 15 minutes complimentary waiting time at Airport Terminals.

  • 10 minutes complimentary waiting time at Cruise Ship Terminals.

 

Waiting time rates

Waiting time is charged in 60-minute increments or part thereof dependent on vehicle type once any complimentary waiting time has been exhausted.  Below waiting time rates include GST.

 

Waiting time rates apply to ALL Acacia accounts, as well as individual bookings, unless otherwise specified on individual rate sheets and/or contracts.

*All flights are tracked via radar and complimentary waiting times only begins from the moment the plane lands, regardless of any flight delays.

Public Holidays & bookings between midnight and 5:00am

Surcharges apply on some public holidays.  This surcharges is applied to all bookings to ensure that our drivers are appropriately remunerated.  Typically, surcharges will be incurred on gazetted public holidays such Christmas Day and New Year’s Eve / New Year’s Day, Australia Day, with the exception being ANZAC Day.  

 In general, split bookings on public holidays will incur waiting time. This is to ensure drivers are remunerated in situations where Acacia determines that the vehicle cannot be hired by other clients.  In these situations, waiting time will be subject to the 20% surcharge.

After Hours Surcharges

A surcharge applies for all vehicle type bookings that begin between 10:30pm and 04:30am.
If a booking begins prior to midnight and continues past midnight, the portion of the journey that continues past midnight will incur a 50% surcharge.

*Certain contracts or rate schedules may contain different terms to those listed above. The terms contained within valid and current contracts and/or rate schedules will supersede the above terms with respect to After Hour Surcharges.

Child restraints

For health and safety reasons and to reduce the spread of COVID-19, Acacia no longer supplies child seats/child restraints.  Under Queensland law, Acacia is not required to provide child restraints in vehicles.  However, children must use seatbelts and remain seated whilst the vehicle is in motion. 

Limits of liability & Insurance

Maximum liability, if accepted, will be limited to a refund for the trip in question.  All care will be taken, but no liability will be assumed.  No claim for liquidated damages, consequential loss for any other costs will be assumed.

Acacia its Operators and Licensees shall be under no liability whatsoever to the Customer for any indirect loss and/or expense (including loss of profit) suffered by the Customer arising out of a breach by Acacia its Operators and Licensees of this contract.

 

Use of Personal Information

Your personal information is used for the hiring of Acacia services and used for that purpose alone. By entering the Acacia secure website booking query facility, you understand that all information provided by you is your sole responsibility and Acacia accepts no responsibility for any incorrect information provided in respect to the hiring made through this facility or any other mode. It is not given to a third party except where the purpose relates to fulfilling the obligations of your hiring. Your personal information may be retained for use in future bookings. If at any time you believe the information is incorrect, you may contact us to have it corrected.

 

Credit Card details are stored securely for the purpose as outlined in our terms and conditions of hire. Acacia staff its Operators and Licensees are obliged under the Confidentiality Deed to keep personal information secure.

 

Disclosure

Acacia may be obliged to surrender your personal information to regulatory authorities and law enforcement officials in accordance with the applicable law. Personal information may also be disclosed to identify, contact or bring legal action against anyone damaging, injuring or interfering with our rights or property.,

Employment Applications
